Reversing.
The appellant, Jones Savage Lumber Company, is a corporation with its chief office at Wilmore in Jessamine county, Ky. It made a contract with the Garrard county board of education in 1927, whereby it undertook to build an addition to the consolidated school building in the Buena Vista consolidated school district in Garrard county. The contract called for the excavation of a basement and the erection of a two-story building. The contract also provided for the digging of a cistern to be used by the school.
