This action of trespass on the case is brought to recover damages for personal injuries. After trial in the Superior Court the jury returned a verdict for the plaintiff for $19,000. Defendant’s motion for a new trial was granted by the trial justice if plaintiff refused to remit $5000 of the verdict. The case is before this court on the exceptions of each party to this decision of the trial justice and other exceptions taken during the trial.
