On January 28, 1966, in the circuit court of Cook County, defendant was convicted of wagering in violation of section 28 — 1(a)(2) of the Criminal Code (Ill. Rev. Stat. 1965, ch. 38, par. 28 — 1) and fined $50. This judgment was affirmed by the appellate court on July 17, 1967, in People v. Mamolella, 85 Ill. App. 2d, 240, and leave to appeal to this court was denied. On January 26, 1968, defendant filed a petition pursuant to section 72 of the Civil Practice Act (Ill. Rev.
