This is the second appeal in this case, the former being by the present appellee and found reported in 78 S. W. Rep., 993, which report see for a statement of the nature of the case. On the last trial there was a judgment in favor of appellee against appellant, Houston & Texas Central Railroad Company, in the sum of $1,425.37.
