The appellant sued the appellee to recover damages for personal injuries, alleged to have been inflicted on appellant through the negligence of the appellee, as charged in some of the paragraphs of the complaint, and purposely inflicted, as also charged in the third paragraph, claiming $12,000.00 damages. The issues joined were tried by a jury, resulting in a *432verdict for the defendant, upon which the court rendered judgment, overruling appellant’s motion for a new trial.

The only error assigned calls in question the action of the trial court in overruling appellant’s motion for a new trial.…
