OPINION
KATZ, Bankruptcy Judge:
Appellant Judith Sarner contends that the trial court improperly granted summary judgment on her complaint to determine dischargeability pursuant to 11 U.S.C. § 528(a)(5). The debtor, her ex-husband, sought to discharge his duty to pay for her furniture. The duty arose from the property settlement agreement negotiated between the Sarners in their marital dissolution. We AFFIRM based on appellant’s failure to meet the requirements of Fed.R. Civ.P. 56(e).
