The relator, John Kohlepp, was sentenced to the New York County Penitentiary on April 30, 1936, from the County Court, county of Bronx,' following a plea of guilty to a violation of section 1897 of the Penal Law (carrying and use of dangerous weapons), as a misdemeanor.
After he had been confined in the New York County Penitentiary for thirty-one months Kohlepp secured a writ of habeas corpus to test the legality of his further detention claiming that he should have been released after he had served twenty-seven months and twenty-five days.
