Violation of conditional discharge and violation of probation proceedings have been brought against the defendant, Andre Pender. The state argues that its evidence, taken as a whole, is sufficient to establish Pender’s constructive possession of marijuana while he was on conditional discharge and on probation, and that he thereby violated the express conditions that prohibited violation of the law.
