The plaintiff, a citizen of Kentucky, has, in this action, sued jointly the Southern Railroad Company of Ken tucky, a citizen of Kentucky, and S. M. Felton, the receiver of this court appointed in the suit of Samuel Thomas against the Cincinnati, New Orleans-& Texas Pacific Railway Company, of which latter suit this court had jurisdiction solely upon the ground of diverse citizenship.
