Plaintiff Richard Southmayd, a 58-year old male, brings this action for age discrimination and retaliation under the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq. and the Tennessee Human Rights Act, Tenn.Code Anno. § 4-21-101 et seq., and for retaliatory discharge under the Tennessee Public Protection Act, TenmCode Ann. § 50-1-304 and Tennessee common law. Defendant Apria Healthcare, Inc., has moved for summary judgment with regard to all of plaintiffs causes of action on the grounds that there are no genuine issues of material fact…
