MEMORANDUM OPINION
HEYBURN, District Judge.
Defendants ask this Court to dismiss this Section 1983 class action suit, in which Plaintiffs allege that juveniles in Kentucky are confined in violation of the Constitution and federal law. Defendants specifically contend that: (1) Plaintiffs cannot claim a right of action to enforce the provisions of the Juvenile Justice and Delinquency Prevention Act (“JJDPA”), 42 U.S.C. § 5601 et seq.; (2) the JJDPA does not apply to Kentucky, since the federal government does not currently provide funding to Kentucky under the Act; (3) Plaintiffs lack standing to…
