VAN VALKENBURGH, Circuit Judge.
This is a suit on a surety bond given by appellant to appellees as trustees in a certain trust deed or mortgage. One Nathan Tatkin and wife were the owners of a building site in St. Paul, Minn., upon which they were about to erect a thirteen-story office building. Appellee Federal Bond & Mortgage Company undertook to finance the construction of this building, and to this end floated a $400,000 bond issue, secured by the deed of trust aforesaid, in which it and Nathan M.
