Action to recover damages for personal injuries alleged to have been caused by negligence of defendants. From judgment as in case of nonsuit, rendered at close of plaintiff's evidence, upon motion of defendants, plaintiff appealed. On ______ November, 1924, plaintiff was at work, as a stonemason, on a building located near Black Mountain, North Carolina, then in process of construction by defendant, J. M.
