In this criminal action, a contract is involved — a contract to kill.

According to testimony at the trial, appellant, Harold Braham, hired Jeffrey Koel-zer to kill David Peterson. Braham was convicted of attempted first degree murder. He appeals on a number of grounds. The first is that the evidence was insufficient to warrant an indictment for attempted murder and also insufficient to withstand a motion for a judgment of acquittal at the close of the state’s case.
