{¶ 1} On January 18, 1997, the appellant, Scott A. Group, shot Robert Lozier to death during a robbery. Group was convicted of aggravated murder and sentenced to death.

{¶ 2} Robert Lozier’s wife, Sandra Lozier, owned the Downtown Bar in Youngstown, Ohio. In late September 1996, the Loziers began buying wine and other merchandise from Ohio Wine Imports Company. Group, who was then employed as a deliveryman for Ohio Wine, made weekly deliveries to the Downtown Bar.
