This appeal follows the second trial of Thomas O. Powell’s suit against the defendant insurance agency (James, Hereford & McClelland, Inc.) for fraud in connection with his application for disability insurance. Powell complained that he applied for disability insurance through the insurance agency, and was denied insurance because of material misrepresentations inserted in the application by the defend ant’s employee to the effect that Powell had not had any previous disability.
