DECISION

James Casale ("Casale") and Charles Benson ("Benson") (collectively "Employees") filed separate complaints for declaratory judgment against the City of Cranston ("City") pursuant to G.L. 1956 § 9-30-1 et seq., requesting that this Court declare that under the provisions of G.L. 1956 § 19-45-1.1, the City has no right of reimbursement for injured on duty ("IOD") benefits paid by the City from any money that the Employees may receive from their uninsured motorist carriers.
