These lawsuits, two in number, stem from the death of an eight-year-old boy, Donald Scott Albanese. He was killed July 4, 1971, when the side of a ditch, in which he and four companions were playing, caved in and buried him. The first action is brought by the boy’s father, Michael J. Albanese, as next of kin, to recover for the wrongful death of his son; the second has been filed by Mr. Albanese as administrator of Donald’s estate to recover damages for pain, suffering and mental anguish sustained by Donald prior to his death.
