This case was referred to Trial Commissioner Herbert N. Maletz with directions to make findings of fact and recommendation for conclusions of law. The commissioner has done so in an opinion and report filed on October 7, 1965. No exceptions were filed to the findings of fact in the commissioner’s report, such facts having been stipulated by the parties. However, plaintiff filed exceptions to the trial commissioner’s recommendation for conclusions of law.
