On September 8, 1981, defendant, Walter Wolak, pled nolo contendere to second-degree murder, MCL 750.317; MSA 28.549, and to felony-firearm, MCL 750.227b; MSA 28.424(2). On September 29, 1981, defendant was sentenced to consecutive prison terms of two years on the felony-firearm conviction and not less than four nor more than fifteen years on the second-degree murder conviction. On September 14, 1982, a panel of this Court peremptorily reversed defendant’s convictions on the ground that the trial court failed to advise defendant that he could not be placed on probation if he pled guilty to…
