Petitioner Jerome Anderson (“Anderson”) seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Anderson was convicted after trial by jury in the Supreme Court, Kings County, for committing three robberies and one attempted robbery of fast food restaurants in Brooklyn between June 10 and June 15, 1998. He raises three bases for habeas relief: 1) he was deprived of due process because the trial court ruled after the close of the evidence that under People v.
