In an action to recover on a personal guaranty, the plaintiff appeals from an order of the Supreme Court, Nassau County (Brown, J.), entered October 3, 2012, which granted the defendant’s motion pursuant to CPLR 3211 (a) (1) and (7) to dismiss the complaint, and denied the plaintiffs cross motion for summary judgment on the complaint.

Ordered that the order is affirmed, with costs.
