MOON, J.

Jerry Richard Knick was convicted of second degree murder in the shooting death of his wife, Lisa Vincent Knick. Defendant, a deputy sheriff of Rockbridge County, claimed that in an effort to frighten her, he pulled his service revolver and pointed it at his wife, who was seated on the floor. He testified that Mrs. Knick pushed herself up from the floor with her right hand and grabbed the barrel of the gun with her left.
