On the 14th day of June, 1941, the, First National Bank & Trust Company, trustee under the will of S. A. Apple, deceased, filed its action to foreclose a mortgage on certain real property in Stephens county, Okla., said mortgage being given to secure a promissory note executed by John F. Carra - way. Judgment was for the plaintiff foreclosing the mortgage and ordering the alleged claims of said defendant quieted in the plaintiff. The petition in error was filed herein by Sam S. Gill and W. A.
