MEMORANDUM OPINION
BOHANON, District Judge.
This matter is before the court on the Defendant, Investors Mortgage Insurance Co.’s (“IMI”), Motion for Summary Judgment under Rule 56 of the Federal Rules of Civil Procedure.
The plaintiff, Firstier Mortgage Co., a/k/a Realbanc, Inc. (“Firstier”), commenced this suit against the alleged bad faith failure of IMI to pay Firstier’s claims on eight policies of private mortgage insurance underwritten by IMI.
