— The land in controversy in this *148action is a part of what is commonly known as the Half Breed Reservation lying on the right hank of the Mississippi River and in the vicinity of Lake Pepin. Jenny Cratt was a half breed or mixed blood of the Sioux nation, and a beneficiary under the treaties and acts of Congress by which the Reservation was set apart and disposed of.
