The first and second assignments of error complain respectively of the refusal of'the learned trial judge to direct a verdict for the defendant and to enter judgment n. o. v. in its favor. In considering these assignments we must regard as established every fact favorable to the plaintiff that is supported by testimony and every like favorable inference that may be drawn from such facts.
