MEMORANDUM OPINION AND ORDER
JAMES HARVEY, District Judge.
This is an appeal from an order by Bankruptcy Judge Harold H. Bobier denying the defendant and counter-plaintiff’s motion to dismiss for lack of jurisdiction.
On March 15, 1974, Atlas Concrete Pipe, Inc., plaintiff-appellee herein, filed a petition under Chapter X for reorganization. This petition was approved and a trustee was appointed.
