This Chapter 11 adversary proceeding is before the Court upon the motions of all defendants to dismiss for lack of subject matter jurisdiction, or in the alternative to abstain, pursuant to Bankruptcy Rule 7012, Rule 12(b)(1) of the Federal Rules of Civil Procedure, and 28 U.S.C. § 1334(c). Defendants Midland Insurance Company, First State Insurance Company, Employer’s Insurance Company and Integrity Insurance Company (“the fourth-layer insurers”) have also moved to dismiss this action for failure to state a claim upon which relief can be granted…
