This is an application for an order striking out and removing from the records of the Board of Elections of Albany County an alleged nomination of Carl 0. Olson by the American Labor Party, for the office of Supervisor, First Ward, Watervliet, N. Y. Briefly, the facts are that on the 10th day of August, 1943, a primary election was held which resulted in a tie vote for the nomination of Supervisor, First Ward, Watervliet, N.
