This was an action of ejectment brought by Sawyer against Hope, to recover the possession of lot one, in block twenty-three, in the city of Alton. It was admitted on the trial, that the defendant was in possession of the lot at the commencement of the suit. The plaintiff adduced the following evidence.
1. A judgment of the Madison circuit court, rendered on the third Monday of September, 1841, against the lot in question and other real estate, for the taxes due thereon for the year 1840.
