In pursuance of an ordance of the city council, approved November 3, 1873, the mayor of the city of Austin entered into a contract with one Sylvester Watts, which provided as follows: 1. “That Sylvester Watts, of St. Louis, Missouri, his assigns, associates or successors, shall have the exclusive right to erect, operate or maintain gas works within the limits of the city of Austin and the additions thereto, and the exclusive right and privilege for laying gas pipes within the limits of said city and the additions thereto, and in and along any street, lane, alley or…
