This matter is before the court on Defendants’ Motion to Dismiss Plaintiffs First Amended Complaint, as well as *713Plaintiffs Motion for Leave to File a Second Amended Complaint. On July 7, 2011, 2011 WL 2670075, I dismissed Plaintiffs first amended complaint, and Plaintiff appealed to the Fourth Circuit. The Fourth Circuit affirmed that decision in part and vacated in part, remanding the case back to this court.
