FARMER, Judge.

The trial court held that a resulting trust existed in that Carolyn St. Clair Berkemeier conveyed real property to her son and daughter-in-law, Richard Dean St. Clair and Shelba St. Clair Evans, in order that the property could be used as collateral for a loan and that, by oral agreement, the property was to be reconveyed to the mother after the loan had been repaid. The couple divorced sometime after this transaction. Ms. Evans appealed to this Court and, in an opinion filed October 6, 1988, this Court determined that the mother was a necessary party and remanded the cause to…
