Plaintiff brought an action to determine his rights in certain oil and gas leaseholds, and appeals from a judgment rendered against him on the pleadings and his opening statement.

The following facts are disclosed by the petition: Prior to December 23, 1930, the Waltom Oil Company; a corporation of which *659defendant Forbes was secretary, was engaged in the oil and gas business in Greenwood county.
