On May 12, 1992, appellee and his wife were involved in a one car accident with a road sign. Officer Hilliard arrived on the scene shortly thereafter to conduct an accident investigation. Hilliard asked appellee who was driving the car. Appellee responded that his wife was driving. Hilliard then asked appellee’s wife the same question, and her answer was the same.
