This is an appeal by the People from an order dismissing a criminal prosecution against 11 defendants.

The record reveals that on March 20, 1969, a grand jury indictment was filed against defendants Don McCoy, Robert McKendrick, Sandra Barton, Cecile Korte, William Candelario, Walter Doyle, Oleg Minakov, Robert Ellison, John D’Amore, Kris Stenz and Dennis Kalfas. The first count of the indictment charged all 11 defendants with possession of marijuana, in violation of Health and Safety Code, section 11530.
