VAN VALKENBURGH, District Judge.
This is an application by plaintiff, under section 724, Rev. St. (U. S, Comp. St. 1901, p. 583), for a rule upon the defendants to produce, before trial, for the inspection of plaintiff, certain books and papers, and for permission to take copies of entries therein; the case now being at issue. It is alleged *412that the books and writings sought contain evidence pertinent to the issue; that they are necessary to the plaintiff in the preparation of his case for trial1.
