This proceeding is in the nature of a concursus, and is the outgrowth of the case decided by us bearing the same title as does this, and reported in 133 La. 317, 62 South. 938.
A full statement of the case is found in the opinion of the court above referred to. It was for the recovery of certain real- property which had been wrongfully adjudicated to the defendant Whitmer after it had been once adjudicated by the sheriff to me plaintiff, Dunlap.
