This action was commenced in the district court of Greek county by Gordon C. Hughes, as plaintiff, against the defendants, to enforce the collection of a promissory note. Defendants answered, admitting the execution of the note, and alleging, in substance, that by the terms of a written contract, in consideration of $1,000 cash and $1,400 evidenced by promissory note, plaintiff agreed to furnish the necessary abstracts, certified copies, and other documents showing good and marketable title in him to certain lands, and to convey the same to defendants; that pursuant to…
