Defendant was charged by information with burglary while armed with a deadly weapon in violation of section 459, Penal Code (count I), assault with a deadly weapon with intent to commit murder in violation of section 217, Penal Code (count II), and grand theft of a firearm in violation of section 487, subdivision 3 of the Penal Code (count III).
