Moran, District Judge.

Defendant was tried before a jury and was convicted on two counts of feloniously assaulting law enforcement officials while they were engaged in the performance of their duties, and a third count of feloniously assaulting a law enforcement official with a dangerous weapon while he was engaged in the performance of his duties. Defendant was also charged with being a habitual criminal and in a separate trial to the court was found to be such. He was then sentenced to concurrent terms of 10 years on each of the 3 counts.
