This action was brought hi the Cape May Circuit Court by Lin wood H. Dallas against the city of Sea Isle City, on a quantum meruit for work of teams used in grading a city street.

*680The defence was that the plaintiff was really the agent of his father, Joseph Dallas, who was a member of the common council of Sea Isle City at the time the work was contracted for and done, and whose vote was necessary to make the contract.

At the trial the learned trial judge directed a verdict for the plaintiff, and from the consequent judgment the defendant…
