FERGUSON, Circuit Judge:
Production Farm Management (“PFM”), an Arizona corporation engaged in the growing and harvesting of citrus fruit in Maricopa County, Arizona, brought suit against the United States Department of Labor (“DOL”), the Secretary of Labor (the “Secretary”) and the Regional Administrator challenging the promulgation, enforcement and implementation of an Adverse Effect Wage Rate (“AEWR”) for the state of Arizona.
