MEMORANDUM OF DECISION AND ORDER

The plaintiff, Joseph Plitnick, Jr. (“the Plaintiff’) brings this single count action against the defendant, Steven Fussell, Plan Administrator for Abbott Laboratories Extended Disability Plan (“the Defendant”), alleging that the Defendant violated the Employee Retirement Income Security Act of 1974, as amended, 29 U.S.C. §§ 1101 et seq.
