Petitioner Spitzer Great Lakes Ltd., Company (“Spitzer”) was assessed a civil penalty by an EPA administrative law judge (“ALJ”) for violations of the Toxic *413Substances Control Act (the “TSCA”), 15 U.S.C. §§ 2601-2692. Relying on misleading language contained in the ALJ’s order, Spitzer filed an untimely appeal with the EPA’s Environmental Appeals Board (the “Board”).
