¶1 The Seattle Municipal Code (SMC) exempts “ [development undertaken by the Washington State Department of Transportation [(WSDOT)] in state highway right-of-way” from the requirement to obtain a grading permit. Nonetheless, the city of Seattle (City) took the position that WSDOT must obtain grading permits for the construction on temporary easements of work bridges necessary to access and construct the West Approach Bridge portion of the State Route 520 floating bridge project.
