In 02-241 (“Gerber /”), plaintiffs Richard Allen Gerber (“Gerber”) and Charles Shumanis, III (“Shumanis”) (collectively “plaintiffs”), who were inmates at the Le-high County Prison (“LCP”) at all relevant periods, filed a complaint under 42 U.S.C. § 1983 (“section 1983”) against 16 institutional and individual defendants asserting various violations of their Eighth Amendment right to be free from cruel and unusual punishment. 1 All but four defendants, Carol Summers, George Weiser, Wexford Health Services and Peter Sea-graves, filed motions to…
