Following a bench trial, the defendant, Tony D. Cleer, was found guilty but mentally ill of three counts of aggravated discharge of a firearm (720 ILCS 5/24 — 1.2 (West 2000)) and unlawful possession of a weapon by a felon (720 ILCS 5/24 — 1.1 (West 2000)). The trial court sentenced the defendant to concurrent sentences of 20 years in prison for one count of aggravated discharge of a firearm and 5 years for unlawful possession of a weapon. On appeal, the defendant argues that the trial court did not conduct a proper fitness hearing (see 725 ILCS 5/104 — 16 (West 2000)). We remand for a new…
