The opinion in this case was originally prepared by Albert, J., and we adopt it substantially as written, except for a modification of the statement of facts claimed by plaintiffappellee.

On the 5th day of February, 1927, Rose Walters made a deed of certain property in the city of Council Bluffs, to her daughter, Daisy May Heaton; and on the same date Rose made a will, the substance of which was to give to a son (Jerry by name) $10, and all the balance of her property to her daughter Daisy May.
